Acceptance of these terms
These Terms of Use govern your use of the Hilo Beauty College LLC website, online forms, document portal, scheduling tools, and related communications (together, the "Services"). By using the Services, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Services.
These terms apply to the website and online tools. Your enrollment, tuition, refunds, attendance, conduct, and completion requirements are governed by the Student Agreement and the Class Rules; if these terms and the Student Agreement conflict, the Student Agreement controls for enrolled students.
Eligibility and minors
You must be at least 18 years old to submit forms or make payments on your own behalf. If you are under 18, a parent or legal guardian must review these terms, complete the Parental Consent form, and sign the Student Agreement with you. By submitting a form for a minor, you represent that you are that minor's parent or legal guardian.
Online forms and electronic signatures
Our forms and documents are delivered through GoHighLevel's document portal. By signing a document electronically, you agree that your electronic signature is legally binding, the same as a handwritten signature, and that we may keep signed documents in electronic form. You agree to provide accurate, current, and complete information and to update us if it changes. Submitting a form does not by itself enroll you; enrollment is complete only when required forms are signed and fees are paid as described in the Student Agreement.
Payments
Payments made through the Services are processed by a third-party payment processor, and your use of that processor is subject to its own terms. All fees must be paid before class begins. Tuition amounts, payment schedules, cancellation, and refund terms are set out in the Student Agreement, which controls over anything on this website.
Communications
By providing your contact information, you agree that we may contact you by email, phone, or text message about your inquiry, enrollment, and program, as described in our Privacy Policy. You can opt out of marketing messages at any time by replying STOP to a text or using the unsubscribe link in an email. Program-related messages (such as schedule changes or safety notices) may continue while you are enrolled.
Acceptable use
You agree not to use the Services to submit false or misleading information, impersonate another person, submit forms on someone else's behalf without authority, upload malicious code, scrape or harvest data, use automated tools or bots to submit forms, or interfere with the site's operation or security. We may block or remove submissions and suspend access for anyone who violates these terms.
Intellectual property
The website, its design, text, images, logos, course materials, and other content are owned by Hilo Beauty College LLC or its licensors and are protected by copyright and trademark law. You may view and print pages for your personal, non-commercial use in connection with your inquiry or enrollment. You may not copy, republish, distribute, or create derivative works from our content, including course materials, without our written permission.
Third-party services and links
The Services rely on third-party platforms, including GoHighLevel (forms, documents, scheduling, messaging), our payment processor, and our website host. Links on this site may take you to those platforms or to other websites we do not control. We are not responsible for the content, availability, or privacy practices of third-party sites and services, and your use of them is governed by their own terms.
Disclaimers
The Services are provided "as is" and "as available." We do not guarantee that the website or forms will be uninterrupted, error-free, or free of viruses. Information on this site about programs, schedules, and pricing may change; the Student Agreement and written communications from the college are the authoritative source for enrolled students. Nothing on this website guarantees admission, licensure, or employment.
Limitation of liability
To the fullest extent permitted by law, Hilo Beauty College LLC and its owners, instructors, and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the website or online Services. Our total liability for claims relating to the website or online Services will not exceed the amount you paid us through those Services in the twelve months before the claim, or one hundred dollars ($100), whichever is greater. This section does not limit liability that cannot be limited under Hawaiʻi law and does not apply to obligations set out in the Student Agreement.
Governing law and disputes
These terms are governed by the laws of the State of Hawaiʻi, without regard to conflict-of-law rules. Any dispute relating to the website or online Services will be brought in the state or federal courts located in Hawaiʻi County, Hawaiʻi, and you consent to their jurisdiction. Disputes about enrollment are handled as set out in the Student Agreement.
Changes and contact
